Z-20-06 Popeye’s Louisiana Kitchen – Rezoning Request  and SPR-20-05 Site Plan Review

 A rezoning request to change the underlying zoning of a parcel totaling approximately 1 acre from a current zoning of Desert Rural Residential (DR-43) to a General Commercial  (GC) Zone.  The parcel is located on the east side of Cave Creek Road, south of the intersection of Cave Creek Road and Olesen Road and is Assessor Parel No. 211-46-009A.  An application for a Site Plan Review was concurrently applied for (Case No. SPR-20-05) to allow for the construction of a fast food restaurant with a drive-thru.

Notice is hereby given that a public hearing will be held by the Town of Cave Creek Planning Commission on THURSDAY, NOVEMBER 19, 2020 at 7:00 p.m.in the Town Council Chambers, 37622 N. Cave Creek Rd.  Because of the current health emergency, the Planning Commission is providing for in person public participation and an option to view and participate electronically. Please view the Agenda at the link below for instructions on how to view and/or participate in the meeting via the Zoom platform.  Seating in the Council Chambers will be arranged for physical distancing.  

The Planning Commission will consider the following requests:  Case No. Z-20-06, a Rezoning Request to change the underlying zoning of a parcel totaling approximately 

1-acre from a current zoning of Desert Rural Residential (DR-43) to a General Commercial (GC) Zone.  The parcel is located on the east side of Cave Creek Road, south of the intersection of Cave Creek Road and Olesen Road and is Assessor Parcel No. 211-46-009A.  An application for a Site Plan Review was concurrently applied for (Case No. SPR-20-05) to allow for the construction of a fast food restaurant with a drive-thru.  The Site Plan Review request will be considered following the determination of the Rezoning Request.

At the November 19, 2020 Planning Commission public hearing, the Commission voted 7-0 to Recommend Approval of the Rezoning Request.

The Town Council will consider the Rezoning Request at its December 21, 2020 meeting at 6:00 p.m.  Please access the Town Council Agenda at https://cavecreek.civicweb.net/filepro/documents/41906 one week prior to the scheduled meeting for information regarding the meeting format and project information. 

The Town Council will consider the Site Plan Review following the Council's decision on the Rezoning Request.

At the December 21, 2020 Town Council meeting, the Council voted 7 - 0  to give first Reading to Ordinance O2020-09 amending the Town's Zoning Map for  Assessor Parcel No. 211-46-009A. from the current zoning of Desert Rural Residential (DR-43) to a General Commercial (GC) Zone.

At the December 21, 2020 Town Council meeting, the Council vote 7-0 to approve the Site Plan Review (Case SPR-20-05)  by a vote of 7 - 0 to allow for the construction of a fast food restaurant with a drive-thru.
