1. RESOLUTION R2003-22 AUTHORIZING THE
MAYOR TO EXECUTE ON BEHALF OF THE TOWN AN INTERGOVERNMENTAL AGREEMENT BETWEEN
THE TOWNS OF CAVE CREEK AND CAREFREE AND MARICOPA COUNTY REGARDING THE
ACQUISITION OF PROPERTY COMMONLY KNOWN AS THE BLACK MOUNTAIN SUMMIT PRESERVE

to approve or deny approval of Resolution R2003-22.
Narrative: The Towns of Carefree and Cave Creek have passed
resolutions authorizing an application to be made for the acquisition of
approximately 250 acres of land located in Maricopa County. Maricopa County
currently owns the property by virtue of a federal patent issued to Maricopa
County on December 10, 1973. In order for the Towns of Carefree and Cave Creek
to acquire the Black Mountain Summit Preserve both municipalities would need to
enter into an Intergovernmental Agreement with Maricopa County and each other.

2. DISCUSSION
AND POSSIBLE SECOND READING OF ORDINANCE O2003-17 AMENDING THE TOWN CODE TITLE
XV LAND USAGE, CHAPTER 151 BUILDING REGULATIONS BY ADOPTING A NEW SECTION
151.40 DEVELOPMENT FEES; ESTABLISHING AN EFFECTIVE DATE; AND PROVIDING FOR
REPEAL AND SEVERABILITY.

Narrative:
ARS 9-463.05 requires a Public Hearing before any increase or decrease
to a new or existing development fee. The Public Hearing was held at the
December 8, 2003 Town Council Meeting. Council will have discussion and
possibly take action on the 2nd reading of Ordinance No. O2003-17 increasing
existing fees and adopting two (2) new fees (water and recreation). Council
will set the level of service and amount of each fee.

3. APPOINTMENT
OF CITIZENS TO TWO SEATS ON THE PLANNING COMMISSION.

Action Needed: Motion to appoint citizens to serve on the Planning
Commission for a 3-year term beginning January 1, 2004 and ending December 31,
2006.
Narrative: This is a request for Council to appoint citizens to two
seats on the Planning Commission. The three-year term begins January 1, 2004
and expires December 31, 2006. Council may interview candidates that have
submitted a letter requesting appointment to the Planning Commission.
