CALL TO ORDER 6:00 P.M.  Vincent Francia, Mayor, 37622 N. Cave Creek Road, Cave Creek, AZ.

EXECUTIVE SESSION: An Executive Session will be held during the Regular Council Session for legal matters pursuant to A.R.S. Section 38-431.03.A. (3) & (4) as follows:

            1.                     Discussion or consultation with the attorney’s of the public body for legal advice and in order to consider its position and instruct its attorneys regarding the public body’s position regarding pending or contemplated litigation or in settlement discussions conducted in order to avoid or resolve litigation.

A.     Bureau of Land Management Patent Easements and Abandonments

 

 

            Council Action Needed:            Motion to convene into Executive Session.

 

The Public Meeting will begin at 7:00 p.m. following the Executive Session.

3.         COUNCIL DISCUSSION AND AUTHORIZATION TO EXPEND FUNDS FOR THE UPGRADE OF THE TOWN OF CAVE CREEK COMPUTER NETWORK SERVER EQUIPMENT AND SOFTWARE.

Council Action Needed:            Motion to authorize the award of contract and expenditure of funds to Insight for the acquisition of the hardware, software and installation services necessary to implement the approved computer network system solution as defined within the proposal received from Insight on October 1, 2004 in an amount of $39,675.25.

 

Narrative:            This is a request for Mayor and Council to authorize awarding a contract and expenditure of funds to Insight for the hardware, software and installation services necessary to upgrade the Town of Cave Creek computer network equipment and software.

4.         COUNCIL DISCUSSION AND POSSIBLE FIRST READING OF ORDINANCE O2004-20 AMENDING THE TOWN CODE TITLE XIII – GENERAL OFFINSES, CHAPTER 130 – GENERAL OFFENSES, SECTION 130.07 – NOISE BY AMENDING THE TITLE OF THE SECTION ALONG WITH THE INCLUSION OF SECTIONS 130.07 (A), (B), (C), (D), (E), (F) AND (G).

 

                        Placed on the agenda by the Planning Department, Town of Cave Creek.

 

                        Public Comment

Council Action Needed:            Motion to approve first reading of Ordinance O2004-20.

 

Narrative:            This is a request for Mayor and Council to consider giving first reading to an ordinance that amends the Town Code Chapter 130 – General Offenses, Section 130.07 NOISE by amending the title of the section to NUISANCES along with the inclusion of Sections 130.07 (A), (B), (C), (D), (E), (F), and (G). Currently nuisances are addressed in both the Town Code and the Zoning Ordinance. The intent of this ordinance is to add clarity, definitions and detail on this issue to the Town Code and once adopted to follow up with removal of the nuisances from the Zoning Ordinance in its entirety.
