REGULAR TOWN COUNCIL MEETING

TOWN OF CAVE CREEK, ARIZONA

MONDAY, FEBRUARY 7, 2005

 

Notice is hereby given that the Town Council of the Town of Cave Creek will hold an Executive Session during its Regular Session, which begins at 5:30 p.m.  The Executive Session will be held to discuss those legal matters set forth on the Executive Session Agenda set forth below, pursuant to A.R.S. Section 38-431.03(A) (3), and (4).

 

CALL TO ORDER 5:30 P.M.  Vincent Francia, Mayor, 37622 N. Cave Creek Road, Cave Creek, AZ.

 

ROLL CALL      Mayor Vincent Francia, Vice-Mayor Ralph Mozilo, Council Members Gilbert Lopez, Grace Meeth, Terry Smith, Shea Stanfield, Jay Williams

 

EXECUTIVE SESSION: An Executive Session will be held during the Regular Council Session for legal matters pursuant to A.R.S. Section 38-431.03(A)(3) and (4) as follows:

                                    EXECUTIVE SESSION AGENDA

1.      Discussion and consultation with the Town’s Attorney to consider its position and instruct its attorneys in order to resolve current litigation:

a.       Southwest Sands v. Town (CV2002-023188)

                        A.R.S. Section 38-431.03(A)(3) and (4).

 

Council Action Needed:            Motion to convene into Executive Session.

 

The Public Meeting will begin at 7:00 p.m. following the Executive Session.

 

PLEDGE OF ALLEGIANCE

 

PUBLIC ANNOUNCEMENTS – General Announcements of interest to members of Council and the public.  There will be no discussion on any announcements.

CALL TO THE PUBLIC

Residents/Visitors are encouraged to comment about any matter not included on the agenda. State Law prevents the Council from taking action on items not on the agenda, except to set them for consideration at a future date.  Please limit your comments to three (3) minutes.

1. Ms. Gellar of the Tonto National Forest will give a presentation to the Mayor and Town Council regarding invasive weeds.

2. Ian McManis, Troop #603 will present his Eagle Scout project to the Mayor and    Town Council.

3.  Wayne Anderson, Town Engineer will report on the Adopt-a-Street Program.

A.Approval of January 3, 2005 Regular Town Council Meeting minutes.

B.Approval of January 18, 2005 Regular Town Council Meeting minutes.

C.Approval of Deed of Gift to the Town for 15-foot dedication of non-motorized vehicular/equestrian/pedestrian trail easement; parcel 211-82-001F donated by Don and Karen Knight.

D.Reappointment of Joseph C. McGill to serve a new five year term on the Building Board of Appeals.

 

Council Action Needed:Motion to approve the items listed on the Consent Agenda.

1.         COUNCIL DISCUSSION AND POSSIBLE FIRST READING OF ORDINANCE O2005-02 AMENDING THE TOWN CODE TITLE XIII-GENERAL OFFENSES, CHAPTER 130-GENERAL OFFENSES, SECTION 130.07-NOISE BY AMENDING THE TITLE OF THE SECTION ALONG WITH THE INCLUSION OF SECTIONS 130.07 (A), (B0, (C), (D), (E) and (F). Public Comment

Council Action Needed:            Motion to approve or deny approval of First Reading of Ordinance O2005-02.

 

Narrative:  This is a request for Mayor and Council to consider giving first reading to an ordinance that amends the Town Code Chapter 130 – General Offenses, Section 130.07 NOISE by amending the title of the section and including additional language. The intent of this ordinance is to add clarity, definitions and detail on this issue to the Town Code and once adopted to follow up with removal of the nuisances from the Zoning ordinance in its entirety.

2.         REQUEST FOR RENEWAL OF OFF-TRACK WAGERING LICENSE REQUEST FROM YAVAPAI COUNTY FAIR ASSOCIATION TO CONDUCT OFF-TRACK WAGERING AT THE SATISFIED FROG (GOATSUCKER SALOON).

Narrative:  This is a request for Council to renew an off-track wagering license for Yavapai County Fair Association dba Yavapai Downs at Prescott Valley at the Satisfied Frog (Goatsucker Saloon) located at 6425 E. Cave Creek Road., Cave Creek 85331.
