NOTICE AND AGENDA

REGULAR TOWN COUNCIL MEETING

                              TOWN OF CAVE CREEK, ARIZONA

                                        MONDAY, APRIL 3, 2006

 

Notice is hereby given that the Town Council of the Town of Cave Creek will hold an Executive Session during its Regular Session, which begins at 6:00 p.m.  The Executive Session will be held to discuss those legal matters set forth on the Executive Session Agenda set forth below, pursuant to A.R.S. Section 38-431.03(A)  (3) and (4).

 

CALL TO ORDER 6:00 P.M.  Vincent Francia, Mayor, 37622 N. Cave Creek Road, Cave Creek, AZ.

 

ROLL CALL      Mayor Vincent Francia, Vice-Mayor Dick Esser, Council Members Kim Brennan, Ernie Bunch, Gilbert Lopez, Thomas McGuire, and Grace Meeth

 

EXECUTIVE SESSION: An Executive Session will be held during the Regular Council Session for legal matters pursuant to A.R.S. Section 38-431.03(A) (3) and (4) as follows:

                                   

EXECUTIVE SESSION AGENDA

1.      Discussion and consultation with the Town’s Attorney to consider its position and instruct its attorneys regarding current litigation:

a.   Southwest Sands v. Town of Cave Creek

2.  Discussion and consultation with the Town’s Attorney to consider its position and instruct its attorneys regarding a Notice of Claim involving the median located on the Southwest corner of Carefree Hwy and Cave Creek Road:

a.   Pacific West v. Town of Cave Creek.

pursuant to A.R.S. Section 38-431.03(A) (3) and (4).

Council Action Needed:         Motion to convene into Executive Session.

 

            The Public Meeting will begin at 7:00 p.m. following the Executive Session.

1.         COUNCIL DISCUSSION AND POSSIBLE AUTHORIZATION TO PURCHASE A NEW  JOHN DEERE GATOR UTILITY VEHICLE FROM A TO Z RENTALS TO REPLACE THE STOLEN UTILITY VEHICLE

Council Action Needed:         Motion to authorize the purchase of a new John Deere Gator Utility Vehicle from A to Z Rentals for an amount not to exceed $10,709.71.

 

Narrative: The Town Engineering Department is requesting to purchase a new Gator Utility Vehicle to replace the one stolen from Town Hall in January 2006. The Town’s insurance has already reimbursed the Town for the stolen vehicle.

2.         DISCUSSION AND POSSIBLE AWARD OF BID TO SUNLAND ASPHALT FOR DOUBLE PASS CHIP SEAL PAVING, SINGLE PASS CHIP SEAL PAVING, FOG SEAL AND EXTRUDED CURB.

                        Public Comment

Council Action Needed:         Motion to award the bid to Sundland Asphalt using the Town’s participation in the ‘S.A.V.E.’ Program for double pass chip seal paving, single pass chip seal paving, fog seal, and extruded curb for dirt roads, paved roads and the sheriff’s parking lot for an amount not to exceed $500,000.

 

Narrative: Motion to authorize the expenditure of funds for double pass chip seal paving, single pass chip seal paving, fog seal, and extruded curb for dirt roads, paved roads and the sheriff’s parking lot for an amount not to exceed $500,000.
