REQUEST                  Approval of an Exception Request seeking relief from the Town of Cave Creek Subdivision Ordinance, Chapter 4-Engineering Standards & Procedures, Section 4.1-Sewage Disposal Systems, B. Requirements, 1.c.: “Applicants proposing subdivisions utilizing individual lot sewage systems requiring percolation shall demonstrate approved percolation tests on each lot prior to the first Planning Commission hearing of the Final Plat.” The proposed subdivision consists of 230 lots on 945 acres located north and east of the intersection of E. Rockaway Hills Road and N. 32nd Street in Desert Rural Residential (DR-190) and (DR-43) Zones.                                       

                       

 

 

Public Hearing

Council Action Needed:         Motion to approve the Exception Request seeking relief from the Town of Cave Creek Subdivision Ordinance, Chapter 4-Engineering Standards & Procedures, Section 4.1-Sewage Disposal Systems, B. Requirements, 1.c.: “Applicants proposing subdivisions utilizing individual lot sewage systems requiring percolation shall demonstrate approved percolation tests on each lot prior to the first Planning Commission hearing of the Final Plat.” This exception requests that First, the Applicant must have a Soils Testing Plan (percolation test plan), which has been approved by the Maricopa County Environmental Services Department prior to the first Planning Commission hearing on the Final Plat; second, the applicant must implement the Soils Testing Plan and have County approval of the results thereof prior to the commencement of on-site infrastructure work for that particular phase of the project; finally, each individual lot must have an approved percolation test result prior to issuance of a building permit for that lot.

           

Narrative:       This is a request for Council to give approval to the Exception Request,

Case #06-03, Cahava Springs pertaining to the Sewage Disposal Systems.

2.         PUBLIC HEARING AND ADOPTION OF RESOLUTION R2006-16 APPROVING THE FISCAL YEAR 2006-2007 FINAL BUDGET

Council Action Needed:         Motion to approve of Resolution R2006-16, a Resolution of the Mayor and Council of the Town of Cave Creek finally determining and adopting estimates of proposed expenditures by the Town of Cave Creek for the Fiscal year beginning July 1, 2006 and ending June 30, 2007, establishing the alternative expenditure limitation amount, and declaring that such shall constitute the adopted budget of the Town of Cave Creek for such fiscal year.

 

Narrative:   This is a request for Council to hold a public hearing, then adopt resolution R2006-16 approving the Fiscal Year 2006-2007 budget and setting the alternative expenditure limitation amount for Fiscal Year 2006-07.

3.         DISCUSSION AND POSSIBLE APPROVAL OF FIRST READING OF ORDINANCE O2006-20 LEVYING UPON THE ASSESSED VALUATION OF PROPERTY WITHIN THE TOWN OF CAVE CREEK, ARIZONA, SUBJECT TO TAXATION, A CERTAIN SUM UPON EACH ONE HUNDRED DOLLARS ($100.00) OF SECONDARY ASSESSED VALUATION SUFFICIENT TO RAISE THE AMOUNT NECESSARY TO PAY PRINCIPAL AND INTEREST ON, AND REGISTRATION COSTS OF, OUTSTANDING GENERAL OBLIGATION BONDS OF THE TOWN (SPUR CROSS RANCH), LESS THE AMOUNT ESTIMATED TO BE RECEIVED FROM OTHER SOURCES OF REVENUE; ALL FOR THE FISCAL YEAR ENDING THE 30TH DAY OF JUNE, 2006 AND DECLARING AN EMERGENCY.

Council Action Needed:         Motion to approve First Reading of Ordinance O2006-20, an Ordinance of the Mayor and the Town Council of the Town of Cave Creek, Maricopa County, Arizona, levying upon the secondary assessed valuation of property within the Town of Cave Creek subject to taxation, a certain sum upon each one hundred dollars ($100.00) of secondary assessed valuation sufficient to raise the amount necessary to pay principal and interest on, and registration costs of, outstanding general obligation bonds of the Town (Spur Cross Ranch), less the amount estimated to be received from other sources of revenue; all for the fiscal year ending the 30th day of June, 2006, and declaring an emergency.

 

Narrative:  This is a request for the Council to give First Reading to Ordinance O2006-20 levying upon the assessed valuation of property within the Town of Cave Creek a certain sum upon each one hundred dollars ($100.00) of valuation, and declaring an emergency. This is the ordinance that authorizes the Town to collect the property tax to pay for Spur Cross Ranch bonds this fiscal year. This is not a new tax. This property tax was approved by the Cave Creek voters at the September, 2000 election to pay for the Town’s share of the purchase of Spur Cross Ranch property.

4.         RESOLUTION NO. R2006-17 DISCUSSION AND POSSIBLE ACTION ESTABLISHING THE MONTHLY COMPENSATION FOR THE MAYOR AND COUNCIL MEMBERS STARTING WITH THE JUNE 2007 TOWN COUNCIL.

Council Action Needed:         Motion to approve Resolution R2006-17, a Resolution of the Mayor and Council of the Town of Cave Creek, Arizona establishing a monthly salary for each Council Member pursuant to A.R.S. 9-232.01 and Town Code Section 30.06 to be effective for all members of Council beginning with their terms that start on Monday, June 4th, 2007.

 

Narrative:  This is a request for the Council to consider and, if deemed advisable, to adopt a resolution establishing the monthly compensation for the Mayor and Council Members beginning with the June 2007 Town Council. The current monthly compensation for Mayor is $500 per month and the compensation for a Council Member is $300 per month. Any compensation change will not go into effect until the start of the next term of office beginning June 2007.
